Firstly I order and direct all my just debts funeral expenses, the charges of proving this my will and other incident disbursements to be paid and discharged by my executrix hereinafter named.
I give to devise unto my loving wife Elizabeth BARNES all singular my freehold lands estate and premises wheresoever situate or lying. To hold to her and her assigns for and during the term of her natural life in law she shall so long continue my widow and unmarried subject and chargeable nevertheless with the payment of the sum or one hundred pounds of lawful British money to my daughter Elizabeth BARNES on her attaining the age of 21years.
On the death of my wife or marriage I give and devised the said lands and premises unto my good friends Moses SMALLCOMBE Gentleman of the parish of Kelson in Somerset and Mark TANNER of the parish of Bitton Yeoman To hold to them the said Moses SMALLCOMBE and Mark TANNER their heirs executors administrators to and for unpon the several uses Trusts Interests and purposes following. ( that is to say) UPON TRUST
to apply rents, interests and profits toward the maintenance education and breeding up of my son David BARNES and my daughter Elizabeth BARNES until my said son shall attain the age of twenty one years and on his attaining such age then in Trust to pay half part of the said rents unto son David BARNES and to pay the other part to my daughter Elizabeth BARNES. In case the Farme shall not then have been already discharged by my said wife but in case my said daughter shall happen to die under the age of 21years then I will and direct the said legacy or sum of one hundred pounds shall sink into and be deemed part of the estate charged with the payment thereof and if it shall happen that my son David BARNES shall die under the aged of 21 years then I give the lands and premises before mentioned unto and equally between my four daughters Catherine CRYER, Ann CRYER, Hannah HILL, Mary STRANGE to hold to them their heirs and assigns for ever
Also I give to my said two daughters Catherine CRYER and Mary STRANGE £10 each.
Also I give to and bequeath to my daughter Ann CRYER £5. and my pint silver Cam?
Also I give and bequeath to my daughter Hannah HILL £5. and my Silver pint Candle cup.
I give to my son David BARNES my silver quarte Tankard. All of which said several legacies to be paid by my executrix within twelve months after my decease, except the silver tankard given to my said son which I will may be retained by my wife and by her use during my said sons minoritory.
And as to all the rest residue and remainder, my monies, securities, plate, household good, chattels, stock, implements of husbandry unto my wife Elizabeth to hold to her and to be Executrix, recommending to her care and protection our infant children David and Elizabeth BARNES.
I appoint Elizabeth BARNES, Moses SMALLCOMBE and Mark TANNER Guardians of the persons and estates of David and Elizabeth BARNES during their respective minorities. David BARNES set my hand and seal this 10th November 1783
