I Charles WHITTUCK of Hanham within the parish of Bitton in the County of Gloucester Gentleman. Do this Twenty fourth day of April in the year of our Lord One Thousand Seven Hundred and Eighty Seven make and ordain this to be my last will and testament in manner and form following. That is to say.
I give to my niece Ann WHIPPY widow, To John WHITTUCK and Abraham WHITTUCKE the two sons of my late nephew Samuel WHITTUCK and my niece Mary WEBB wife of John WEBB of the City of Bristol Cooper and to my Grand niece Elizabeth LUDLOW spinster daughter of Isaac LUDOW of the same City Soapboiler the sum of One Hundred Pounds a piece and to each of them
To Mary WEBB Spinster daughter of my above named Niece Mary WEBB To my niece Grace HARDING wife of Samuel HARDING Butcher To my niece Hester BAYLY late Hester BARNES. To Sarah BOLT wife of William BOLT of the parish of Syston otherwise Syson in the County of Gloucester Yeoman and to my nephew Abraham BARNES I give the sum of Fifty Pounds a piece to each of them.
To Charles COLE Cordwainer and to Robert LEONARD Coalminer £30.00 a piece to each of them. I give to Hester WHITTUCK and Sarah WHTTUCK daughters of my nephew Abraham WHITTUCK £20.00 each. And to my friend The Reverend John THOMAS Disenting Teacher £10
all the above legacies to be paid by my nephew Charles WHITTUCK of the City of Bristol Hatter son of my late brother Joseph WHITTUCK out of my freehold estates by the year next after my decease.
Also I give to John BUSH and Martha BUSH the two children of my late kinswoman Rachel BUSH deceased £50.00 a piece and to each of them to be paid when they reach 21years with interest in the mean time at the rate of four pounds per cent per annum by my said nephew Charles WHITTUCK.
I give and devise unto him my said nephew Charles WHITTUCK all those my freehold estates situate in the parish of Syston some time in the tenor or occupation of Thomas JONES yeoman but now of the aforesaid William BOLT. And also all that messuage or tenement with the stable garden and orchard etc estimated to be eleven acres situate in Bridge Yate situate in Wick and Absom parish some time since in the tenure or occupation of Robert NOBLE Coalminer but now of William PRIGG Yeoman and Also all that close of pasture ground I purchased of Dennis ROGERS harrier situate in Hanham now or late in the tenure or occupation of William PRINCE malster. And also all that my ruinous messuage or tenement in or near Oldland Common within the parish of Bitton some time since in the tenure or occupation of Robert NOBLE but now of the said William PRIGG. To have and to hold all and singular the same estates messuage or tenements closed pieces etc my nephew Charles WHITTUCK his heirs and assigns for ever subject to the payment of the several percunairy legatees herein before named. And also subject to and charged and chargeable with the one payment unto my before mentioned Nephew Abraham BARNES of three shillings per week which I hereby give to him during his natural life to be paid on Saturday in every week. And also subject to and charged and chargeable with the due payment unto my sister in law Mary WILLIAMS who now lives with me of ten shillings per week which I hereby give to her during her natural life to be paid to her on Saturday every week.
And I do accordingly hereby charge the same estates and premises with the one payment of the same espective weekly sums with powers of distress and entry on the same estates and premise and every part therof in the usual manner for recovery of the same respectively on non payment thereof.
Also I give and bequeath to my said sister in law Mary WILLIAMS all that my messuage belonging in the hamlet of Oldland now or late in the tenure or occupation of Robert LEONARD and which I now hold for the remainder of a term of years determinable on one life To hold the same unto her the said Mary WILLIAMS her excecutors etc. I likewise five to said Mary WILLIAMS the bed and bedstead whereon she usually sleeps with the bolster pillows bed cloaths and other furniture hereto belonging. Also the chest of drawerers Night stool in my bed chamber my half pint silver cup and the chaire whereom she usually sits. Two C0** Brick chairs All my china and earthen ware, my cream pot and tea tongs my tea kettle, *** crest by her bedside, my two little brass kettles, the several brases usually placed on the shelf over the chimney piece two pewter plates and two pewter dishes two half kildoe kifiw? All my trenchards? With my *lices and tongs the little round table usually standing in the pantry and the little round table usually standing in the kitchen. All which things I direct to be delivered to her by my executor hereinafter named as soon as convenient after my death.
Item I give unto my grand nephew John WHITTUCK of Bitton Cordwainer brother of my before named grand nieces Hester and Sarah WHITTUCK all that my close or piece of lying in Oldland in the parish of Bitton now or late in the tenure or occupation of Thomas FOX yeoman. To hold the same unto him my grand newphew John WHITTUCK his heire and assigns for ever. I give unto James WHIPPY son of the before named Ann WHIPPY all that piece of ground containing one acre situate Upton common field in the parish of Bitton late in the tenure or occupation of him the said James WHIPPY to hold to him and his heirs for ever.
Item I give unto my niece Mary THOMPSON wife of John THOMPSON of Bitton aforesaid Brass worker all that my mesuage or tenement with the orchard closes pieces and parcels of ground and land situate in Upton in the parish of Bitton now or late in the tenure or occupation of (name left out) HARRIS widoe. To hold the same unto her the said Mary THOMPSON and her assigns for and during the term of her natural life and after the decease of her the said Mary THOMPSON to her children begotten and to be begotten equally as tenants in common.
Item I give unto my said Nephew Charles WHITTUCK and to my friends William LUDLOW of the said city of Bristol gentleman and Joseph HARRIS of Hanham. All that my leashold piece or parcel of ground called RYMERS containing one acre situate in parish of Bitton And county of Gloucester aforesaid with the appartenances late in the tenure or occupation of Isaac LEONARD Gentleman and now of his widow. To hold the same unto them the said Charles WHITTUCK, William LULDOW and Joseph HARRIS heire Executor administrators and assigns for all the estate Term and interest which I shall have herein at the time of my death .
UPON TRUST and for the intents and purposes hereafter mentioned and declared of and concerning the same, that is to say, UPON TRUST to ** the same and ***** and pay the ***** yearly rnt and profits from time to time arising therefrom, after payment of all outgoings and expenses attending the said trust unto and for the proper use and benefit of the minister or ministers from time to time and at the time being ministering at HANHAM aforesaid to that part of the congregation of protestant Dissenters called Baptist belonging to the meeting house situate in the Pithay in Bristol aforesaid which usually assemble for the worship of almighty God at the meeting house at Hanham aforesaid and I Hereby direct that as often as any **** of them the said Charles WHITTUCK William LUDLOW and Joseph HARRIS or any future trustee to be chosen in their trust as after mentioned shall happen to die That then and so often the surviving Trustees or Trustee at the time being shall with all convenient speed chase some other honest and discreet person or persons belonging to the said congregation of Protestant dissents to be a Trustee or Trustees with such surviving Trustee or Trustees at the time being in the place of every Trustee so dying for the management of the said Trust and Trust estate. Every of which new Trustee to be chosen shall be vested with the same powers as the said Trustees hereby named and as **** as if originally *****and chosen in this my will.
ITEM I give to the before name Sarah BOLT? My silver Tankard, the curtains in my parlour chamber and also my book of sermons called Harviles? Sermons. To my said nephew Charles WHITTUCK the Furnace and Boiler and my two standing bedsteads in my Dwelling house he having purchased the ******** after my decease of the said Dwelling house. I give to James WHITTUCK before named the Bed in my parlour. To the said Charle COLE my book intitled the Explanation of the Testament. To my before named niece Mary THOMPSON my silver pint cup to my before named nephew Abraham BARNES All my wearing apparel cloth linen and woollen of every denomination. And to my servant Joan FOX My large cooking plas? Which is in my parlour. Such specific legacies respectively to be delivered to my said several legator thereof as son as conveniently may be after my decease.
I give the sum of Three pounds to be disposed of to and amongst such poor people of the parish of Bitton aforesaid as my executor hereinafter appointed shall think proper to distribute the same unto and in such proportions and manner as my said Executor shall think proper. And the further sum of three pounds to be disposed of to and among such of the poor members belonging to the society meeting at the Baptist meeting house at hanham aforesaid as my said executor shall think proper to distribute the same unto and in such proportion and maner as to ** my said Executor shall seem meet?
I give to my servant of *** shall be in my service at my death a new suit of mourning. And as to all the rest and reside of my estate both real and personal monies debts chattels and *** whatsoever and wheresoever which shall belong to me at the time of my decease after payment of my just debts funeral expenses pecuniary legacies the charges of proving this my will and other incident disbursements I give devise and bequeath the same and every part therof unto my said nephew Charles WHITTUCK son of my said brother Joseph WHITTUCK his heirs and executor administrator and assigns for ever to and for his and ****own propective and benefit. And I do herby make constitute and appoint him my said nephew Charles WHITTUK sole executor of this my will and lastly I do revoke all former wills by me at any time heretofore made and declare this only to be my last will and testament.
IN WITNESS whereof I the Said Charles WHITTUCK the testator have to his my said last will and testament contained in this and the four preceding sheets of paper to the first four sheets thereof set my hand and to this fifith and last my hand and seal the day and year first herein before written
Signed sealed published and declared. By the said testator Charles WHITTUCK as and for his last will and testament in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed are names as witnesses to the excecution thereof.

Mr Charles WHITTUCK took an Oath to say that he will well and faithfully perfom the same will by first paying his debts and then the legacies therein contained so fat as his affects will extend and the law binds you that you will exhibit an inventory of all and singular the goods chattels rights and credits of the said deceased into the register of the Lord Bishop of Gloucester and render a just and true account of your administration thereof when you shall be thereunto lawfully required. You do also swear that the whole Personal estate of the said deceased at the time of his death die not in value amount to the sum of six hundred pounds. So help you god Kiss the book.
On the 15th May 1788 the above named Charles WHITTUCK was duly sworn
