This Indenture made the (blank) day of (blank) Octavo Anne Regine Anno Domini one thousand seven hundred and nine, Betweene Benedict HALL of Highmeadowe in the parish of Staunton in the county of Glouc., Esq only son and issue male of Henry Benedict HALL late of the same parish deceased and Edward COLSTON of Mortlake in the county of Surrey merchant of the one part and John COSTER of Upper Redbrook in the parish of Newland in the county of Gloucestershire gent of the second part
Witnesseth that as well for and in consideration of the surrender of a lease by Indenture bearing date the sixth day of July which was in the year of our Lord Christ one Thousand six hundred ninety and one, made by and from the said Henry Benedict HALL to the said John COSTER by the name of John COSTER late of the parish of St Augustines in the City of Bristol and now of Redbrook in the County of Gloucester gent of the tenements and hereditaments herein after mentioned to be demised, for a term of three score years commencing from the five and twentieth day of March then last past, at the yearly rent of twenty pounds payable half yearly, as also for and in consideration of a competent Summe of money, to the said Benedict HALL by the said John COSTER before the ensealing and delivery herof, well and truly payd the receipt whereof is hereby acknowledged, and for and in consideration of the rent hereby reserved and made payable as aforementioned The said Benedict HALL – and he the said Edward COLSTON at the request and by the direction and appointment of the said Benedict HALL signified by his joyneing herein and signing and sealing herof have
All that Mill or those Mills formerly used or imployed as a paper mill and now Converted into a copper works with the appurtenances together with the dwelling house stable, Smyth's shop, and several outhouses with the gardens backsides courts yards and appurtenances to the same belonging and appertaining. All which said demised premises are situate lying and being in Upper Redbrook aforesaid and contain by estimation one acre of ground (be the same more or less.) And which now are and for severall years past have been in the tenure and occupation of the said John COSTER and are bounded by the road way from the highmeadowe aforesaid towards the river Wye and Monmouth on the Northwest a Grist mill called The Kings mill on the North East, an old roadway between the said demised premises and the lands now or late of George WYRHALL on the southeast and a little tenement in the tenure of Mary PALMER And another little tenement in the tenure of John HOWELL (alias) JONES on the southwest
Together with all ways waters watercourses ditches stanks mills, millwheels and appurtenances to the same belonging or in any wise appertaining To have and to hold the said dwelling houses, Mill, copper work houses, outhouses, Stables, buildings gardens, Orchard, Land, pooles, ponds, stanks, waters, watercourses and all and singular the said hereditaments and premises hereby mentioned or intended to be leased and every part and parcel thereof unto the said John COSTER his Executors Administrators and Assignes from henceforth for and during and unto the full end and term of Ninety and nine years next ensuing fully to be compleat and ended if Thomas COSTER and John COSTER sones of the said John COSTER and John TOMPSON Junr, son of John TOMPSON of Redbrooke aforesaid or any or either of them so long, shall live, yieleing and paying therefore yearly and every year during the said terme unto the said Edward COLSTON and Benedict HALL or to such one of them his heires Executors or Administrators or to him or them to whome the reversion And Inheritance of the said leased premises shall from time to time during the continuance of the said leased terme appertain the rent of sume fo twenty pounds of lawful money of great Britaine at the days or times in the yeare most usuall (that is to say) on the five and twentieth day of March and Nine and twentieth day of September yearly by even and equal portions provided also nevertheless if it shall happen that the said yearly rent of twenty pounds shall be behind and unpaid in part or in all by the space of thirty days next after any or either of the sayd days or times wherein the same ought to be payd accouding to the reservation Thereof hereby as aforesaid (the same being lawfully demanded then and so often and from thenceforth, it shall and may be lawfull to and for the said Benedict HALL and Edward COLSTON or either of them their or either of their heires Executors Administrators or Assigns, or such of them who from time to time during the continuance of the said leased term shall be legally entitled to the said rent into the said leased premises to enter and the same to have Again repossess and enjoy as in theire any or either of their former Estate or condition anything herein conteyned to the contrary thereof in any wise notwithstanding And the said John COSTER doth for himself his heires Executors and Administrators convenant promise and grant to and with the said Benedict HALL and Edward COLSTON and each of them theire and eich of theire heires executors and Assignes by these presents in maner and forme following (that is to say)
that he the said John COSTER his Executors Administrators and Assignes or some or one of them, shall and will from time to time and at all times hereafter, during the continuation of the said leased terme and Estate hereby granted well and truly pay and satisfie the said yearly rent of twenty pounds, hereby reserved to the persons, and in such sort manner and forme as the same shall from time to time grow due and become payable, accourding to the continuance of the terme and Estate hereby leased at his and their owne costs and charges Well and sufficiently repaire amend maintaine and keep as well the said dwelling house copper works and all other the houses and buildings hereby or mentioned to be hereby leased as all and other the houses and buildings hereby demised or mentioned to be hereby leased as all and other the housing and building which shall be hereafter erected and built on the demised premises or any part thereof in by and with all and all manner of needful and necessary reparations and amendments, And the same so well and sufficiently repaired in the end or other sooner determination of the terme hereby granted, shall and will quietly and peaceably surrender and yield up unto the said Benedict HALL his heirs or Assignes, And the said Benedict HALL for himself his heires and Assignes convenant grant and agree to and with the said John COSTER his Executors Administrators and Assignes that he the said John COSTER his Executors Administrators and Assignes paying the rents and performing the covenants before mentioned to be on his and their part performed payd fulfilled and kept, shall and may during the terme herein and hereby before demised peaceably and quietly to have hold occupy possess and enjoy All and singular the said demised premises and with the appurtenances without any the lawful let suite Trouble molestation or eviction of him the said Benedict Hall his heires or Assignes or the said Edward COLSTON his heirs Execurors Aministrators or Assignes or any other person or persons lawfully claiming or pretending lawfully to claime from by or under him them or any or either of them And the said Edward COLSTON for himself his heires Executors Administrators and Assignes doth convenant and grant to tnd with the said John COSTER his Executors Administrators and Assignes that he the said Edward COLSTON hath not done or committed any act matter or thing wiatsoever whereby or wherewith the said premises or any part thereof are is or shall or may be charged or incumbored in title Estate or otherwise howsoever In Witness whereof the parties to these present Indentures (wrote on parchment having the double sixpenny stamps thereon) Interchangeably their hands and seales have sett the day and year first above written.
