I TIMOTHY THOMPSON of Keynsham in the county of Somerset shopkeeper do make and declare this my last will and testament in manner following I give devise and bequeath unto Charles THOMAS of Clarence Place Coronation Road in the Parish of Bedminster and Charles SUTTON of Keynsham aforesaid tailor all my lands houses and all other my freehold estate whatsoever and wheresoever situate to hold to them that said Charles THOMAS and Charles SUTTON and the survivor of them the heirs and assigns of such survivor upon trust to permit and suffer my wife Isabella Mary THOMPSON to receive and take the rents if owed and profits thereof and during the term of her natural life
and from and after her decease that they my said trustees and the survivor of them shall and so stand of my said freehold estate upon trust for my three children James Woods THOMPSON, Mary Lawson THOMPSON and Joseph Woods THOMPSON and their heirs and assigns to be equally divided between them share and share alike as rents in common and not as joint tenants
and as to my business and shopkeeper my will and mind is and I do hereby authorize my wife to carry on and continue the same in case she shall consider the same to be advantageous for the maintenance of herself and the three children but if not she shall be at liberty to sell and dispose thereof and to apply the proceeds to the payment my just debts if necessary but if not required then such proceeds to be invested on Government or real security and the interest to be received by my wife for life and afterwards the principal to be equally divided between my said three children my farming store assets rents and all other my implements of husbandry I direct to be sold and the proceeds to be applied towards the payment of my just debts and
my will further is I do further direct that my executrix hereinafter named shall collect and get in my best debts and other monies due to me and shall apply the same also to the payment of my debts and as my will and mind is and I do hereby direct and declare that in case my farming store good debts and other monies should not be sufficient to discharge of my debts that then they my trustees or the survivor of them or the heirs or assigns of such survivor shall have full power to sell and dispose of so much and xxxx part of my said freehold estate as they or he shall think most appropriate and shall apply the proceeds of such sale to the payment of such debts as the farming store and other means before mentioned are not sufficient to liquidate and I devise that the receipt or receipts of my trustee or trustees for the time being shall be a sufficient discharge to any person purchasing under the power of sale before contained
and I do direct that in rare situation of the two trustees hereby appointed shall refuse decline or become incapable to assist in the trusts of this my will it shall be lawful for such trustees or the survivor or the heirs or assigns of both survivors to appoint one or more trustee or trustees to act in the reason or stead of the trustee or trustees so refusing declining or becoming incapable to act as aforesaid and thereupon the estate shall vest in such new trustee or trustees as if he or they had been appointed a trustee or trustees by this my will
and I direct my said trustees or the trustees or trustee for the time being of this my will shall pay and satisfy to the executors or himself all costs and expenditure to which they or he may be put in the trusts herein whereas all to all other my Personal Estate
I give and bequeath to my said wife and I appoint her my executrix of this my will to witness whereof I have hereunto set my hand this sixteenth day of June in the year of our Lord one thousand eight hundred and forty-seven. Proved at London 28th October 1847 before the Judge by the Oath of Isabella Mary THOMPSON widow the relict the sole annuitant to whom admon was administered having been first sworn by common duty to administer.
