1880 WILL OF SARAH WILMOT OF PORTISHEAD

This is the last will of me Sarah WILMOT the wife of James WILMOT of Spring Cottage, Portishead in the County of Somerset gentleman Whereas under and by virtue of a certain deed dated the second day of September one thousand eight hundred and seventy nine I am possessed as my separate property independently of my said husband and of certain personal estate now in exercise of the power given to me by the said deed and of every other power now or at the time of my death hereunto enabling me I direct that my separate personal estate shall be disposed of manner following namely

I bequeath the legacy or sum of £80 to my son Arthur WEDMORE of Denison Grason county Texas United States of America farmer I direct my trustees herein after named namely my sons Samuel WEDMORE and Albert WEDMORE to stand possessed of a sum of £60 upon trust to invest the same in their names in the Post Office Savings Bank and upon further trust to pay one moiety of the said sum of £60 and of the accumulation thereof to each of my grandchildren Adelaide Emma WEDMORE and Rhoda Willord WEDMORE (children of my late son John WEDMORE late of Falkland Hamilton, Ontario, Canada West, farmer deceased) as and when they respectively shall attain the age of twenty one years

And I declare that in the event of the death of either of them under the age of twenty one years the share of her so dying of and in the said sum of £60 and of and in the accumulation thereof shall belong to the survivor of them And in the event of the death of both of them the said Adelaide Emma WEDMORE and Rhoda Willord WEDMORE under the age of twenty one years the said sum of £60 and the accumulation thereof shall fall into and form part of my residuary estate I direct my trustees and executors to pay the legacy duty and incidental expenses chargeable on all the preliminary legacies herein before bequeathed by this my will so that the legatees may receive the full amount thereof

And as to all the rest residue and remainder of my residuary separate personal estate I give devise and bequeath the same unto and equally between my son Thomas WEDMORE of Portishead aforesaid farmer my son Samuel WEDMORE of Bristol wholesale grocer my son Albert WEDMORE of Portishead aforesaid grocer and my daughter Sarah Hann DAW wife of Joshua DAW of Exeter outfitter

I direct that every legacy or gift by this my will made in favour of a female shall be for her sole and separate use and be subject to her disposition not withstanding coverture and so that her receipt alone shall be good discharged to my trustees and executors

I appoint my said sons Samuel WEDMORE and Albert WEDMORE trustees and executors of this my will Lastly I revoke all other testamentary writings In witness whereof I have hereunto set my hand this ninth day of September one thousand eight hundred and seventy nine.

Signed by the said testatrix Sarah WILMOT as and for her last will and testament in the presence of us both present at the same time who at her request in her sight and presence and in the presence of each other have subscribed our names as attesting witnesses thereto

Proved at Bristol the sixteenth day of December 1880 by the affirmation of Samuel WEDMORE son of the deceased one of the executors to whom administration was granted limited to all such personal estate the deceased by virtue of a certain deed poll bearing the date the second day of September 1879 and of every other power herenabling had a right to appoint or dispose of and has said by her will appointed or disposed of accordingly but no further or otherwise Power being reserved of making the like grant of probate to Albert WEDMORE son of the deceased the other executor.

The testatrix Sarah WILMOT (wife of James WILMOT) was late of Spring Cottage, Portishead in the county of Somerset and died on the eighth day of November 1880 at Heslington, York City in the county of York. Under £600.
