1863 WILL OF THOMAS WILMOTT OF SISTON

This is the last will and testament of me Thomas WILMOTT of Webbs Heath in the parish of Siston in the county of Gloucester I direct my debts funeral and testamentary expenses to be paid by my executors out of any money which may come to their hands by virtue of this my will and subject thereto I give the use and enjoyment of all my messuages lands and hereditaments of whatsoever nature or tenure

And of all my personal estate and effects unto my wife Anna Maria for her life And after her decease I give my six cottages all adjoining together and the newly built stable and so much garden ground and such outhouses as shall at my decease be occupied by the persons who shall then occupy the six cottages And which six cottages are now occupied by myself, George HAYDEN, Thomas NOBLE, Richard FUSSELL, William HORNE and William STINCHCOMBE and are situate at Webbs Heath in the said parish of Siston unto and equally to be divided between my two daughters Isabella and Susanna WILMOTT absolutely for all my interest therein subject nevertheless and I do hereby charge the same with payment in three months after the decease of the survivor of me and my wife of the sum of one hundred and eighty pounds to my executors and trustees hereinafter named

And I give my cottage occupied by John EVANS and the cottage in course of erection adjoining thereto and so much garden ground and such outhouses as shall at my decease be occupied by the persons who shall then occupy the said two last mentioned cottages and which are also situate at Webbs Heath aforesaid unto my son George WILMOTT absolutely for all my interest therein subject nevertheless and I do hereby charge the same with payment in three months after the decease of the survivor of me and my wife of the sum of forty pounds to my executors and trustees herein after named

And I give my two cottages and gardens situate at Cann Corner in the parish of Bitton Gloucestershire now occupied by James LITTLE and John FLUE unto my daughter Matilda AUSTEN her heirs and assigns subject nevertheless and I do hereby charge the same with payment in three months after the decease of the survivor of me and my wife the sum of forty pounds to my executors and trustees hereinafter named And I direct my executors and trustees to stand possessed of the said sums of one hundred and eighty pounds forty pounds and forty pounds herein before directed to be paid to them

And also of all the rest and residue of my money and personal estate and effects whatsoever and of all my real estate (if any) not herein before disposed of upon trust for and to divide the same into five equal shares and to pay and divide three of such shares unto and equally between my children James WILMOTT, Sarah PEARCE and Elizabeth TREHORNE and upon trust to stand possessed of one other equal fifth share of the said trust monies and thereout in the first place to pay unto Edwin WILMOTT son of my daughter Mary HALES the sum of nineteen pounds nineteen shillings and to pay the remainder of the last mentioned fifth share unto the said Mary HALES and upon trust to stand possessed of the remaining fifth share of the said trust monies for and equally between all the children of my deceased daughter Ann WOODINGTON who shall be living at the decease of the survivor of me and my wife

And I declare that the receipts in writing of the executors and trustees of this my will shall discharge the persons paying to them the said legacies or sums of one hundred and eighty pounds forty pounds and forty pounds from seeing to the application thereof

And I appoint my sons James WILMOTT and George WILMOTT executors and trustees of this my will hereby revoking all former wills by me heretofore made In witness whereof I have hereto set my name this sixth day of July eighteen sixty three. The mark of Thomas WILMOTT

Signed by the said testator Thomas WILMOTT as and for his last will and testament in the presence of us present together who in and before leaving his presence and in the presence of each other have attested the said will and subscribed our names as witnesses thereto the above will having been first read over and explained to the said testator who appeared perfectly to understand the same.

This is a codicil to the foregoing will of me Thomas WILMOTT
I hereby revoke the legacy of nineteen pounds nineteen shillings which I have by the said will directed to be paid to Edwin WILMOTT son of my daughter Mary HALES out of one equal fifth share of certain parts and the residue of my estate specified in my said will And instead thereof I herby direct that the sum of nineteen pounds and nineteen shillings shall be paid in the first place out of the entirety of the same certain parts and residue of my estate so specified in my said will unto the said Edwin WILMOTT the same to be paid to him in three months after the decease of the survivor of me and my wife And after payment of the said legacy of nineteen pounds and nineteen shillings the residue of the same estate shall be divided and paid in the same manner as I have by my will given the residue of my estate except that the legacy of nineteen pounds nineteen shillings given by my will to the said Edwin WILMOTT shall not be deducted from the fifth share which I have by my will given to his mother and she shall be entitled to a full fifth share without such deduction In all other respects I confirm my said will

In witness whereof I have hereto set my name this twenty ninth day of July 1863 The mark of Thomas WILMOTT

Signed by the said testator Thomas WILMOTT as and for a codicil to his last will and testament in the presence of us present together who in and before leaving his presence and in the presence of each other have attested the said codicil and subscribed our names as witnesses hereto the above codicil having been first read over and explained to the said testator who appeared perfectly to understand the same and made his mark thereto in our presence.
